What is SMS Marketing Software?
When people talk about SMS marketing software, they are usually referring to your service provider’s messaging platform. Most SMS service providers have software that its users log into. Once logged in, users can upload and manage their phone lists, design automated messages that are sent out when certain conditions are met, create message templates, and add customizations such as a recipient’s name.

Is Text Message Marketing Legal?
Every country has different laws and regulations regarding text messages. The first rule to understand about text message marketing legality is that if your recipients opted in to your messages, it is legal to send them text messages.
In the United States, the Telephone Consumer Protection Act (TCPA) prohibits sending messages to consumers without their consent. Three ways to grow your list and maintain a record of your recipient’s subscription request is having them text a keyword to join a list, have customers fill out a paper form, or have customers fill out an online form.
Canada’s Anti-Spam Legislation (CASL) functions similarly to the TCPA in the USA.
The European Union laws follow their General Data Protection Regulation (GDPR). While GDPR covers a number of areas and can have costly consequences for companies that are not compliant, businesses that follow these seven rules can send marketing messages to their customers:
- Obtain consent
- Report any security breaches to customers within 72 hours
- Provide customers with access to their personal data
- Provide customers with the right to reuse their data outside the business
- Provide customers with the right to delete their data completely
- Deploy appropriate security measures to safeguard data collection
- Have the capability to appoint a data protection office, if needed
In the United Kingdom, laws generally align with that of the EU, through their Privacy and Electronic Communications Regulations (PECR) and Data Protection Act.
If you want to make sure you are above board in every country, you can safely send out messages if you receive written consent and confirm the recipient’s opt-in.
Is SMS Marketing Digital Marketing?
SMS marketing is one tool that digital marketers use to reach their customers. Digital marketing essentially is any marketing effort that uses an electronic device or the internet. This includes search engines, ads, social media posts, and blogs.
